Report from the website Financial Intelligence dealt with the case involving the betting site Blaze, which accumulates complaints and lawsuits from users who claim that their bets have not been paid. Dr. Matheus Puppe, partner in the TMT, Privacy & Data Protection area at Maneira Advogados, was interviewed to talk about the precautions that should be taken with this type of platform.

Company hired celebrities – and even football clubs – and accumulates legal proceedings in eight Brazilian states

In recent weeks you may have come across the name Blaze and a controversy involving figures such as Neymar, Felipe Neto, Carlinhos Maia, Diggo, and other Brazilian celebrities, as well as football clubs such as Santos and Botafogo. The platform, which presents itself as an online casino, has taken over the networks and the internet.

WHAT IS BLAZE?

Operating in Brazil since 2019, Blaze is a virtual casino and sports betting platform. Among the games offered by the company are Roulette, Blackjack, Slots Machines, Poker and the famous rocket. Although gambling is prohibited in Brazil, Blaze operates through a loophole: it has its headquarters abroad, more specifically in Curaçao, a Dutch island known as a tax haven.

“These companies operate in a kind of legal limbo, creating roots abroad. As a result, they end up operating in an open digital environment, where people can access these websites from other countries”, highlights Philipe Monteiro Cardoso, a lawyer specializing in Digital Law.

Blaze is operated by Prolific Trade N.V., but all the names behind the company are not known for sure. According to the casino, today there are more than 40 million users on the platform. In recent months, Blaze has gained popularity after being promoted by big names on the internet and sponsoring football clubs, such as Botafogo.

HOW THE CASE GAINED STRENGTH

Blaze had already aroused suspicion, but it was two weeks ago that the case gained national attention. A video published by Daniel Penin with the title “Take from the poor and give to influencers” has already accumulated more than 4 million views. In it, Penin investigates who the owners of Blaze are and arrives at an astonishing result, which you can see below:

So, the YouTuber investigates how Blaze works and talks about the company's partnerships. Penin also accuses the platform of paying influencers every time a customer loses in betting. Some names mentioned in the video are Felipe Neto, Carlinhos Maia, Viih Tube, Jon Vlogs, Gkay, MC Poze, Mel Maia and Diggo.

WHO OWNS BLAZE?

Penin went deeper into the investigation and discovered that the owner of the domain blaze.com.bris the Brazilian Erick Loth Teixeira. The information was released by the YouTuber on Wednesday (7). Penin tracked the name through the Whois platform, which publishes information about internet domains. Still, there is no confirmation about other names behind the company.

ACUMULATED PROCESSES

A survey carried out by OCCRP (Organized Crime and Corruption Reporting Project), in partnership with the Bitcoin Portal, found 15 lawsuits against Blaze in eight Brazilian states: São Paulo, Minas Gerais, Bahia, Ceará, Paraná, Distrito Federal, Mato Grosso and Pernambuco.

In the last six months, the platform has accumulated more than 5,700 complaints on Reclame Aqui, with only 18 responded. Most customers say they have not received the money they won in games or have had their account reset.

INFLUENCERS ARE CHARGED

To date, Blaze has not officially commented. The explosion of the case generated a wave of indignation. The public began to demand influencers and celebrities who promoted the company. Neymar limited comments on Instagram and Felipe Neto deleted the online casino's advertising records, in addition to deleting a message posted on June 5th, in which he defended Blaze.

Jon Vlogs, one of the main influencers behind Blaze, spoke out on Twitter. The YouTuber manages a program that, according to him, signed contracts with 400 influencers to promote the casino. Jon stated that “he is aware of everything and will take a position soon”.

“A point of attention in this story is the little or almost no traceability and verification of these betting sites. But the central factor, in my analysis, is how much people follow celebrities and influencers and make the assumption that if they are recommended by them, these games are reliable, without analyzing the whole”, highlights Arthur Igreja, specialist in technology and innovation.

BLAZE IS NOT AN ISOLATED CASE

This is not the first controversy involving a betting company. The JetX rocket game, created by Cbet.gg, accumulated more than 800 complaints on the Reclame Aqui website in just six months last year. The cases are similar: zero accounts, money not received, false advertising and even withdrawals that did not reach the bank accounts of those who “won” the game.

As they do not have a headquarters in Brazil, a CNPJ or any representation here, it becomes very difficult to take legal action against this type of company. “What can be done in the face of this “legal limbo” is to create analogies with current regulations, seeking support in the Civil Code and the Consumer Protection Code”, highlights Cardoso. Even so, the lawyer warns: as the companies are outside the country, the losses are difficult to repair.

AN IMPORTANT ALERT

The Blaze case once again sparked an alert to the risks behind these games. “It is important to understand that the chance of losing the money used in these games is very high”, warns Cardoso.

In other words, this type of game does not work as an extra income.

“When we talk about electronic games, it is important to check if there is in fact a registered company, if there is Compliance and if there are any problems. A quick search on Google can work. The fact is that the digital world lacks some legal regulations that are slowly being put into force”, highlights Matheus Puppe, partner in the TMT, Privacy & Data Protection area at Maneira Advogados.
