  • The chances of approving tax reform in the Senate in 2023 are great, says expert

The program “Direito ao Ponto”, from Canal Rural interviewed Dr. Eduardo Lourenço, partner at Maneira Advogados, to talk about tax reform and the prospects and impacts for the agribusiness sector.

STRAIGHT TO THE POINT

The chances of passing the tax reform in the Senate in 2023 are great, says expert

Reducing the tax rate is the first item on the FPA agenda in the Senate discussion

Voting on tax reform in the Senate should begin between the end of October and the beginning of November. The prospect that it will be approved in 2023 comes from lawyer specializing in tax law, Eduardo Lourenço.

Tax reform is the topic of this week's interview on the program Direto ao Ponto.

“It would be very good for the country in general to approve it from the end of this year and next year we can discuss complementary legislation, ordinary laws and then put the tax reform text into practice”, points out Eduardo Lourenço.

Approval in the Chamber and importance of agro

The expert recalls that tax reform has been discussed for 50 years. According to him, given the text options and the need to discuss the topic, the work carried out by the Parliamentary Agricultural Front (FPA) before approval in the Federal Chamber was “paramount”.

“Is the text approved in the Chamber perfect? Maybe not. But, it is much better than the options we had. We have advanced by at least 12 points for the agricultural sector and there is still a lot to improve in the Senate.”

Rate reduction

Eduardo Lourenço emphasizes that the approval of such points shows that the importance of agribusiness and the agricultural sector was recognized for the development of Brazil.

“And for agribusiness in general, we had the recognition that agricultural inputs, agricultural products, raw materials will have a tax rate of 60% of the reference rate. What does this mean? If we have a tax rate of 30%, the agribusiness tax rate will be 12%.”

The expert comments that in the Senate the first item on the FPA's agenda in relation to tax reform is that the rate be reduced by 80%.

“So, if I have a general rate of 30%, I will have a rate for agribusiness of 6%. This is an important claim. And along with this claim, which we have already advanced a lot, we have the issue of selection”.
