In the same week that more than 2,500 people, including Elon Musk, signed a letter asking for a pause in artificial intelligence experiments, the Italian government investigates the OpenAI tool

Two days after an open letter signed by more than 2,800 people, including businesspeople like Elon Musk, Google and historians like Yuval Harari, called for a pause in AI research and development, the Italian government banned the use of ChatGPT, OpenAI's conversational system, alleging non-compliance with the local Privacy Law. Legal bodies and authorities began a series of investigations. This fact begins a new phase of discussions about the use of artificial intelligence and, according to experts, raises new alerts about the use of ChatGPT.

Rodrigo Helcer, AI specialist and founder of Stilingue, explains that the event in Italy, despite being emblematic, does not go to the heart of the matter. "Blocking one player or one tool does not solve the important regulatory issue for the entire category. OpenAI is the king of the AI game right now, but that is not where the biggest risk lies. The biggest risks are in the use of language models developed without the intensive investment that OpenAI has been making, and there are countless examples."

“I believe that some legal adjustments will need to be made by OpenAI and by companies that will use the ChatGPT solution or any other artificial intelligence solutions with this same degree of impact, to ensure real alignment with the regulatory and legal needs of different countries. This is an adjustment movement that I believe will also be overcome, so that the solutions can be used in a mature and more “responsible” way by people and organizations in the future”, explains Fernando Moulin, Partner at Sponsorb, professor and expert in business, digital transformation and customer experience.

“Determining blocking is always an extremely drastic and indigestible measure, which impacts countless users and services resulting from the use of this application”, warns Luis Fernando Prado, partner in the Digital Law area at Prado Vidigal Advogados. For Matheus Puppe, partner in the TMT, Privacy & Data Protection area at Maneira Advogados, "AI has already presented part of its many challenges. Data protection is just one of the regulatory difficulties it already causes. Italy's step, however, I see as hasty, since AI still needs adjustments and this could slow down the development of a feared tool, but powerful in a good way."

In relation to the letter from Elon Musk & Cia, Helcer reinforces that it expresses a maturity in society's relationship with technology so that the same previous mistakes on the internet are not made. "We cannot ignore everything that has already happened in relation to data and privacy. This letter does represent a call for sensitivity. But it is problematic to place the people who sign it against OpenAI, as if it were a counterpoint, since the company itself, through its three founders, has been making this warning since the beginning of the intensification of AI tests."

“Just days after the letter signed by the world's leading professionals such as Elon Musk and Steve Wozniak, Italy took a step forward and completely banned the use of ChatGPT due to concerns about data collection rules. Not only that, but it also accuses Microsoft of not imposing age limitations on chat rules. These two events connect to the same source. Although the petition is more generalized, we already see that this gear, in a massive, today it is having problems complying with the rules. The concerns come from the fact that, if we are already having problems complying with the rules, what does the future hold?”, ponders Gaby Diamant, CEO of BridgeWise.
