ANPD launches information security guide for small businesses

Last Monday (4/10), the National Data Protection Authority (ANPD) launched an information security guide, aimed at small processing agents.

The objective of the material is to guide agents on good practices in implementing information security measures to protect processed personal data. To this end, the document indicates administrative and technical measures.

There is also a checklist to make it easier to view suggestions, such as awareness and training programs, contract management, access controls, data storage guidelines and vulnerability management.

The guiding role of the ANPD regarding these initiatives is provided for in item XVIII of article 55-J of the General Protection Law of Data. According to the organization's director, Nairane Rabelo Farias Leitão, “inducing and directing the protection of personal data is an important mission of the ANPD and advancing in the provision of tools and document models can help organizations come into compliance with the LGPD.”

According to Anna Luiza Berredo, partner in the data protection area at Maneira Advogados, by pointing out such measures, the guide promotes “a safer institutional environment, resulting in gains in trust with data holders.”

She recalls that the guide continues the public consultation, still ongoing, on the draft resolution that regulates the application of the LGPD for small agents, with more simplified procedures. The guide complements the rules of the draft, points out the lawyerMarcelo Cárgano, from the regulation and protection of personal data area at Abe Giovanini Advogados,

“While the LGPD brings new and reinforced requirements to guarantee the security of the personal data processed, the ANPD itself recognizes that the implementation and maintenance of information security measures may require excessively high investments, with the potential of even making the activities of these small processing agents unfeasible”, explains Cárgano. Thus, the guide proposes to “reach a point of balance” between the capabilities and needs of these agents and data subjects.

According to the lawyer, most of the suggested measures are simple: “They dispel the myth that compliance with the LGPD is something unattainable or exclusive to large companies.”

ANPD recommends, for example, employee training to prevent phishing attacks. Furthermore, it suggests keeping physical documents locked, not sharing logins and passwords, locking computers, reviewing contracts and providing information security clauses, implementing software with registration and access control and reducing the amount of data used.

“Small processing agents or not, ensuring the security of personal data is not only possible but is everyone’s duty,” concludes Cárgano.
